  • the type of Web browser that visitors use;

ACP only collects personally identifiable information about you when you voluntarily submit such information to us. For example, we may ask for information about you if you:

  • apply for a job at ACP;

  • subscribe to an ACP newsletter, e-mail alert or other subscription service.

ACP may use non-personally identifiable information collected from visitors to the Site to:

  • guide decisions about the development of the Site;

These files enable us to recognize a unique cookie on your Web browser, which in turn enables us to learn which advertisements visitors to our Web site see. The information that we collect and share is anonymous and not personally identifiable. It does not contain your name, address, telephone number, or e-mail address.

6. Other web sites/linked third parties

The Site may contain links to third-party Web sites. Our privacy statement does not apply to these linked sites. In addition, we do not endorse and are not responsible for the privacy practices or content of any of the linked sites. We generally have no control over the way in which the sponsors of the third-party sites collect and use information. Therefore, we recommend that you review the posted privacy statements on any Web site you visit.

7. Security

We maintain physical, electronic, and procedural safeguards to maintain the confidentiality, security, and integrity of visitors’ personally identifiable information. Although we strive to maintain the highest standards of security and privacy, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. ACP cannot guarantee or warrant the security of any information visitors transmit to us via the Internet.

8. Changes

ACP reserves the right to revise or change the terms of this Statement in the future to reflect modifications to our site. Please check this Statement periodically for any changes and our current practices. Whenever the Statement is updated, the date of the update will appear at the bottom of this page.

9. Canceling an E-mail Subscription/Service

You may cancel an e-mail subscription or service or update your personal information by accessing the subscription page and following the instructions on that page.

10. Business users

This Statement does not apply to information provided to us by business entities, even if the information is transmitted to us through the Site. If you are a business user and use our Site or any of our business applications in the course of your business with us, information you submit to our Site or the business applications will be governed by our agreements with you and may be used and disclosed in the same manner as information we receive outside of this Site. We will only use and disclose such information in accordance with all applicable laws.

11. Arbitration

The laws of the State of California shall govern this Agreement. Any controversy or claim arising out of or relating to this Agreement, or breach thereof, shall upon written demand of either party served upon the other party, be settled by arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, and judgment on the award rendered by the arbitrators may be entered in any court having jurisdiction thereof. Each party shall, by notice to the other party given within ten (10) days of the date of the written demand referred to above, appoint one person to serve as its party-appointed arbitrator. The persons so appointed shall, within twenty (20) days of the aforementioned written demand, jointly select a neutral arbitrator. If any party fails to appoint a person within the said ten-day period, the other person so appointed shall select the arbitrator.

The parties specifically confer upon the arbitrator the right to direct each of the parties to produce in advance of the hearing whatever documents and other information the arbitrators deem appropriate. Requests for additional discovery shall be governed by and decided in accordance with California law. The parties agree that the arbitrators shall not have authority to award punitive damages. The arbitration shall take place in San Diego, California, unless the parties mutually agree to another location. This paragraph shall survive any termination or expiration of this Agreement.
